Terms and Conditions for Pass Purchase

These terms and conditions (the "Agreement") govern the purchase of a pass by an individual ("Passholder") from Targhee Athletics. By purchasing the pass, the Passholder agrees to be bound by the terms and conditions set forth herein.

1. Eligibility: The pass is available for purchase only by individuals who possess a current and active Targhee Athletics unlimited membership ("Membership"). The Passholder must maintain an active Membership throughout the duration of the pass validity period.

2. Pass Validity: The pass is valid for a specified duration, as determined by Targhee Athletics. The Passholder is entitled to enjoy the benefits and privileges associated with the pass during this period.

3. Passholder Responsibilities: 3.1. Accurate Information: The Passholder agrees to provide accurate and up-to-date information at the time of purchase, including but not limited to their full name, contact details, and Membership information. 3.2. Membership Verification: Targhee Athletics reserves the right to verify the Passholder's Membership status at any time during the pass validity period. If the Membership is found to be inactive or terminated, Targhee Athletics may revoke the pass without refund. 3.3. Personal Use Only: The pass is strictly for personal use by the Passholder and cannot be transferred, shared, or sold to any other individual.

4. Pass Benefits and Privileges: 4.1. Facility Access: The pass grants the Passholder access to Targhee Athletics facilities, as determined by the Membership level, during regular operational hours. 4.2. Services and Classes: The Passholder may participate in services and classes offered by Targhee Athletics, subject to availability and applicable terms and restrictions. 4.3. Discounts and Offers: The Passholder may be eligible for discounts, promotions, or special offers, as determined by Targhee Athletics.

5. Pass Cancellation and Refunds: 5.1. Passholder Request: The Passholder may request a pass cancellation within the applicable refund policy, as specified by Targhee Athletics. 5.2. Termination by Targhee Athletics: Targhee Athletics reserves the right to terminate the pass and revoke access to facilities and benefits if the Passholder violates any terms and conditions set forth in this Agreement or engages in any misconduct.

6. Limitation of Liability: Targhee Athletics shall not be held liable for any injuries, damages, losses, or claims arising out of the use of the pass, facilities, or services, except in cases of willful misconduct or gross negligence.

7. Amendments: Targhee Athletics reserves the right to modify or amend any terms and conditions of this Agreement at any time. Notice of any changes will be provided to the Passholder via email or by posting the updated terms and conditions on the Targhee Athletics website.

8. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Targhee Athletics is located. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

By purchasing the pass, the Passholder acknowledges that they have read, understood, and agree to abide by all the terms and conditions outlined in this Agreement.
